Welcome to St. Anthony’s HomeMart also hereby referred as “we”, “us” or “HomeMart” or homemart.lk. By using homemart.lk website and its related services, products, tools and software, you agree to be bound by these terms and conditions (“Terms”). You also accept the Terms when you create an account, make a purchase as a guest, or log into HomeMart account. HomeMart reserves the right to change, modify, add, or remove portions of these Terms and Conditions at any time without any prior notification. Changes will be effective when posted on the Site with no other notice provided. Please check these Terms and Conditions regularly for updates. Your continued use of the Site following the posting of changes to Terms and Conditions of use constitutes your acceptance of those changes.

Access to this Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason this Website is unavailable at any time or for any period.

2. Information on Our Site

We try to be as accurate as possible with the information we present on the HomeMart website. We will make reasonable efforts to accurately display the attributes of the products we sell. We do not warrant that product descriptions or other content is accurate, complete, or error free. Prices and promotions are subject to change and may vary from those offered in our stores. We cannot confirm the availability or price of an item until you place your order. Despite our best efforts, sometimes an item in our catalog may not be available, the offer may have been misstated, or an item may be mispriced. For any of these reasons, we may cancel your order or we may contact you for instructions on the order. If any liability is not able to be excluded by law, we limit our liability to the resupply of the relevant information or services.

This homemart.lk website may contain links to external websites. HomeMart does not sponsor, guarantee or approve of any material or representations in those websites. Nor do we warrant that material on linked sites is free of any computer virus, defects or infringements.

Homemart.lk website may include certain third party details such as supplier information, contact details, details of professionals, HomeMart does not guarantee or take responsibility of the content of any third party details.

We may use cookies to gather data in relation to this website and you consent to us doing so (although you may be able to disable cookies on your web browser).

3. Placing an Order

a. Order Acceptance and Billing

Prior to accepting an order we may also request additional information from you. Verification of information may be required prior to the acknowledgment or completion of any purchase. We reserve the right to refuse or cancel an order for any reason including limitations on quantities available for purchase, inaccuracies, or errors in product or pricing information, or problems identified by our credit and fraud avoidance department.

All billing information you provide to us must be truthful and accurate. Providing any untruthful or inaccurate information is a breach of these Terms of Use and may result in cancellation of your order. We reserve the right to refuse or cancel an order for any reason including limitations on quantities available for purchase, inaccuracies, or errors in product or pricing information, or problems identified by our credit and fraud avoidance department.

By confirming your purchase at the end of the checkout process, you agree to accept and pay for the Products, as well as all shipping and handling charges and applicable taxes. If your order is canceled after your credit card (or other payment account) has been charged, we will issue a credit to your credit card (or other applicable payment account) in the amount of the charge. We will attempt to contact you if all or any portion of your order is canceled or if additional information is required to accept your order.

b. Pricing Information and Payments

HomeMart cannot confirm the price or availability of an item until after your order is placed. Pricing or availability errors may occur on the Homemart.lk website or through suppliers. HomeMart reserves the right to cancel any orders containing pricing or availability errors, with no further obligations to you, even after your receipt of an order confirmation or shipping notice from HomeMart. HomeMart may, at its discretion, either contact you for instructions or cancel your order and notify you of such cancellation. Pricing for products may be different on the Homemart.lk website or from prices available in HomeMart stores or on HomeMart Social media platforms.

c. Product Availability

We list availability information for products listed on the homemart.lk website, including on each product information page. Beyond what we say on that page or otherwise on the Site, we cannot be more specific about availability. Please note that dispatch estimates are just that. They are not guaranteed dispatch times and should not be relied upon as such. As we process your order, you will be informed by e-mail or sms if any products you order turn out to be unavailable.

Please note that there are cases when an order cannot be processed for various reasons. The homemart.lk website reserves the right to refuse or cancel any order for any reason at any given time. You may be asked to provide additional verifications or information, including but not limited to phone number and address, before we accept the order.

d. Shipping and Delivery

Products will be shipped to an address designated by you, if applicable, so long as such address is complete and complies with the shipping restrictions contained on the homemart.lk website. All transactions are made pursuant to a shipping contract, and, as a result, risk of loss and title for Products pass to you upon delivery of the Products to the carrier. Some Products may be available for pick up at physical HomeMart store locations. Estimated delivery times are determined based on the method of shipping chosen when Products are purchased and the destination of the Products.

e. Return Policy

Return Period:

1.Homemart must be informed within 3 days for Electronics & 7 days for other brands of receiving the item to be eligible for return.

2.Item must be in the original packaging with tags intact in the same condition it was delivered in.

3.Items returned after the Return Period has lapsed will not be accepted.

4.Our customers’ safety is of utmost importance, and we take hygiene very seriously. Therefore, items such as underwear, bras, briefs, and swimwear are not eligible for return.

5.Items to be returned are the sole responsibility of the customer until they reach us, and customer needs to ensure items are properly packed to prevent any damages end route to us. Items damaged end route will not be accepted.

6.It is the customer’s responsibility to ensure proof of postage for parcels that contain items to be returned.

7.Upon receiving a return request, Homemart will require minimum 03-04 business days to process your request and obtain approval to issue a replacement unit.

8.If granted approval, Homemart will require minimum 02-03 business days to ready the replacement unit.

Refund policy:

A full refund will only be provided in the event a replacement unit for the size/specific model is no longer available. The refund will not include any delivery charges borne by the customer for return of item.

All refunds will be processed within 3-5 working days. Processing refunds back to your credit card/ bank account may require additional time depending on the bank due to its own operational time for which homemart.lk will not be responsible.

In the event of change of mind, the customer is only entitled to a credit note for the value of their purchase. homemart.lk will not be issuing refunds for change of mind purchases.

f. Cancellation by Seller

Our order confirmation to you does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. At any time after receipt of your order, we may accept, decline, or place quantity or other limits on your order for any reason. We may impose these limits on a per-person, per-household, per-order, or any other basis. If we reject, limit, or otherwise modify your order, we will attempt to notify you using the email address you provide to us. If we cancel an order or part of an order that we’ve already charged you for, we’ll refund you the full amount of the canceled portion of the order.

g. Third Party Installation

HomeMart is not responsible for the content, work, executions and installations of any third-party supplier, party or company with which the homemart.lk operate or otherwise interact, nor is HomeMart responsible for the acts or omissions of any operator of any such supplier. Your use of any such third-party installation, work is at your own risk, and will be governed by such third party’s terms and policies (including its privacy policy).

4. Intellectual Property

The Homemart.lk website and all Materials, and all copyrights, trademarks, and other intellectual property rights there (collectively, the “IP”) are owned or controlled by or licensed to HomeMart, and are protected by Sri Lanka trademark, copyright, and other intellectual property laws. Materials are licensed (not sold) to end users. Subject to your compliance with these Terms of Use, and solely for so long as you are permitted by HomeMart to use the Homemart.lk website, you may access, view, download, and print the Materials for your personal, non-commercial use only; provided, however, that you (1) retain all copyright, trademark, or other proprietary designations contained on all Materials; (2) do not modify or alter the Materials in any way; and (3) do not provide or make available the Materials to any third party in a commercial manner. In addition, subject to your compliance with these Terms of Use, and solely for so long as you are permitted by HomeMart to use the Homemart.lk website account, we permit you, on a limited, non-exclusive, revocable, non-transferable, non-sublicensable basis, solely for your personal, non-commercial use. If you fail to comply with any of the terms or conditions of these Terms of Use, you must immediately cease using the homemart.lk website and customer account.

No license, right, title, or interest in the homemart.lk website or any Materials is transferred to you as a result of your use of the homemart.lk website or your accessing, viewing, downloading, or printing of the Materials. You may not reproduce (except as noted above), publish, transmit, distribute, display, modify, create derivative works from, sell, or participate in any sale of or exploit in any way, in whole or in part, any of the Materials or the homemart.lk website. The homemart.lk website and Materials may be used only as a personal shopping resource. Any other use, including the reproduction, modification, distribution, transmission, republication, display, or performance, of the homemart.lk website and the Materials is strictly prohibited. The compilation (meaning the collection, arrangement, and assembly) of the HomeMart Materials is the exclusive property of HomeMart and is also protected by Sri Lanka trademark and copyright laws.

HomeMart and homemart.lk names and logos, and all other graphics, logos, page headers, button icons, scripts, and service names included in or made available through the homemart.lk website are trademarks of HomeMart. All other marks are the property of their respective companies.

5. Dispute Resolution

With respect to any dispute regarding the homemart.lk, all rights and obligations and all actions contemplated by these terms and conditions shall be governed by the laws of Sri Lanka as if the Terms and conditions were a contract wholly entered into and wholly performed within Sri Lanka. Any dispute relating in any way to your visit to the homemart.lk shall be referred to arbitration in accordance with the rules of the Sri Lanka, by sole arbitrator, and the Arbitration proceedings shall be held in English Language. Any payment related disputes will be handled by St. Anthony’s Hardware (Pvt) Ltd, No 524, Sri Sangaraja Mawatha, Colombo 10, Sri Lanka.

6. Loyalty Points

Loyalty points can be earned through each purchase made during website transactions. You can also view your accumulated points balance under the “My Account” tab. Please note that points cannot be redeemed through the website; however, they can be redeemed at our physical stores located at Nawala (No. 456, Nawala Road, Rajagiriya) and Sangaraja (516, Sri Sangaraja Mawatha, Colombo 10).

7. Privacy

You acknowledge that any personal information that you provide through the homemart.lk will be used by HomeMart in accordance with HomeMart’s Privacy Policy (available at https://homemart.lk/privacy-security/homemart-privacy-policy), which may be updated by HomeMart from time to time. If you purchase an item on homemart.lk sold by a HomeMart suppliers, HomeMart may share certain information with that supplier to permit the supplier, as applicable, to fulfill and ship your order, process returns, and provide customer service.

You authorize your data to disclose to HomeMart and its third-party service providers your mobile number, name, address, email, network status, customer type, customer role, billing type and other subscriber status and device details, if available, solely to verify your identity and prevent fraud for the duration of the business relationship. 8. Limitation of Liabilities

HomeMart provides all information, content, and other material made available through the homemart.lk on an “as is” and “as available” basis. We make no representation or warranty that any HomeMart products will meet your requirements, or that it will be uninterrupted, secure, or error free.

Any warranty on any product sold through a homemart.lk is provided by the manufacturer of that product. To the fullest extent permitted by applicable law, HomeMart will not be liable for any indirect, incidental, or consequential damages attributable to your use of any HomeMart or any product or service purchased through a homemart.lk. The limitations set forth in this section will not limit or exclude liability for personal injury or property damage caused by products you purchase through a homemart.lk due to negligence, intentional, willful, reckless or malicious misconduct, or fraud.

9. Termination of Use

We may, in our sole discretion, terminate your account or your use of the homemart.lk at any time. You are personally liable for any orders that you place or charges that you incur prior to termination. We may change, suspend or discontinue all or any aspects of homemart.lk at any time without prior notice.
